Real estate transactions involving death,
incapacity, and estate planning are among the most complex—and highest risk—situations agents encounter. Misunderstanding authority, ownership, or legal processes can delay transactions, create liability, and jeopardize client outcomes. Probate Pitfalls & Power Plays is designed to give real estate professionals the clarity and confidence to navigate these transactions effectively. This course walks agents through the full lifecycle of estate-related real estate—from determining who has legal authority to act, to understanding probate, trusts, taxation, and valuation implications.
By the end of this course, participants will be able to:
- Identify who has legal authority to act in real estate transactions involving death or incapacity
- Recognize when probate is required and how it impacts timelines and decisions
- Interpret title and ownership structures to determine how property transfers
- Understand the limits of Powers of Attorney and how incapacity affects transactions
- Work effectively with fiduciaries such as executors, administrators, and trustees
- Navigate trust-owned property and verify proper authority before proceeding
- Recognize key financial factors, including valuation, taxes, and liens
- Apply risk management best practices and know when to pause and involve professionals
